The Agency, marketed as A(i)GENCY, is operated by Zolvo Studios LLC, a Texas limited liability company. Our registered address for formal legal notice is published in the full Terms of Service and Privacy Policy; day-to-day contact is support@the-agency.app.
These terms are governed by the laws of the State of Texas. Disputes not resolved informally are brought exclusively in the state or federal courts located in Harris County, Texas.
Missions, settings, provider connection choices, usage estimates, and workspace references live on your device unless you send content to a selected AI provider or connected tool. Local app data remains until you delete it, clear app data, or uninstall the app. Provider-side retention follows that provider's policies and account settings.
What we hold on our servers: your account email, plan and entitlement state, Lemon Squeezy billing identifiers, and a usage ledger recording provider, model, mission id, token counts, and cost. We never store prompt or response text.
Legal bases: performing our contract with you (account, subscription, and managed routing), our legitimate interests (security, abuse prevention, and service reliability), and compliance with legal obligations (tax and accounting records).
Recipients, by category: a managed authentication and database provider, a cloud application hosting provider, a software distribution provider for installer downloads, Lemon Squeezy for subscription billing as our merchant of record, and — for managed Pro requests only — Anthropic, OpenAI, or Google. GDPR Art. 13(1)(e) permits disclosure by category; the AI providers are named individually because which one receives your content depends on a choice you make in the app, and Lemon Squeezy is named because it appears as the seller on your payment statement. These providers may process data in the United States and other countries; where required we rely on standard contractual clauses or an equivalent transfer mechanism.
Changes to this list: the categories above are accurate as of the effective date. We may add, replace, or remove sub-processors as the service changes. Material changes are reflected here and in the in-app Legal & Trust screen with an incremented version number, and you can request the identity of a specific current sub-processor at support@the-agency.app.
Retention: account, billing, and usage-ledger records are kept for the life of your account plus the period necessary for tax, accounting, and dispute resolution, then deleted or anonymized.
Your rights: subject to applicable law, including GDPR Arts. 15–22, you may access, correct, delete, or obtain a portable export of your account data. Export and deletion are self-serve — see Support & deletion below. If you are in the EEA or UK you may also lodge a complaint with your local data protection authority. We do not sell or share personal information.
Your own provider login or API key is used. Provider usage is billed directly by that provider.
Enabled requests pass through the A(i)GENCY backend for account checks, usage recording, quotas, and server-side controls before reaching the underlying provider.
Prompts, attachments, repository snippets, selected context, and tool results may be sent to the active provider. The provider and model you select determine where processing occurs.
You are responsible for the files, repositories, provider accounts, credentials, and tools you connect. AI output can be incorrect and should be reviewed before you rely on it or apply it to production systems.
Do not use A(i)GENCY to create malware, steal secrets, bypass access controls, violate laws, infringe rights, or access accounts and files without authorization.
Auto-edit and elevated permissions: the app can optionally run providers with broader write and execute permissions in a bound repository or folder. You enable these modes at your own risk. Zolvo Studios is not responsible for data loss, corrupted repositories, unintended commits, or system damage resulting from actions a provider takes under permissions you granted.
Disclaimer and limitation of liability: the app is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Zolvo Studios LLC’s total liability arising out of or relating to the app will not exceed the amount you paid us in the twelve months before the claim arose, and we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or business interruption.
Minimum age: you must be at least 16 to use the app and at least 18 to purchase a subscription.
Basic ($10 per month) and Pro ($20 per month) are recurring monthly subscriptions billed by Zolvo Studios LLC through Lemon Squeezy. They renew automatically every month until you cancel. Cancel anytime from your account’s billing portal; cancellation stops the next renewal and access continues to the end of the paid period.
All subscription charges are non-refundable, including for partial billing periods.
BYOK usage charges remain with your AI provider and are separate from your subscription. Managed Pro usage is metered against your spend cap based on provider-returned token counts; displayed costs are estimates unless provider-billed values are explicitly available.
The current disclosure does not assume a separate always-on telemetry service. Operating-system or local-environment diagnostics may still exist. If a release enables app-managed telemetry or crash reporting, users should be told what is collected before diagnostics leave the device.
The desktop app uses no cookies. This site and the account portal use browser local storage to hold your session and refresh tokens — strictly necessary to keep you signed in — and set no advertising or analytics cookies.
The site loads no third-party fonts, tag managers, or analytics scripts — fonts and scripts are served from our own origin. The one exception is that the download and changelog pages read the public release list from GitHub’s API to show current version information, which discloses your IP address to GitHub for that request. No other page contacts a third party.
Encrypted transport, OS-keychain storage for provider and account secrets, and database access controls protect account and billing data. We will notify affected users and any required regulator without undue delay after a security incident involving personal data.

Use Download my data and Delete account in your account portal, or Legal & Trust → Your data in the desktop app. Deletion cancels any active subscription, removes your profile and sign-in, and anonymizes the billing and usage records we are required to retain. It cannot be undone.
For anything else, email support@the-agency.app. Include your platform, provider, and a short description of the issue, but never include passwords, API keys, or sensitive project files.
